Effective for all users in Kohat, Khyber Pakhtunkhwa

Welcome to YumYaak Kohat! Please read these Terms carefully. By using our app, you agree to these rules regarding Cash on Delivery, family privacy, and respectful conduct.

1. Acceptance of Terms

By accessing YumYaak, you agree to be bound by these Terms. If you do not agree, please do not use our services. We reserve the right to modify these terms at any time. Continued use of the app constitutes acceptance of updated terms.

2. Service Scope, Halal & Allergies

YumYaak connects you with local restaurants in Kohat. We act only as an intermediary.

Halal & Hygiene Disclaimer:

While we require our restaurant partners to comply with local food safety and Halal standards, YumYaak does not independently verify the ingredients or Halal certification of every dish. The Restaurant is solely responsible for food preparation and hygiene.

Allergies: YumYaak does not guarantee that food is allergen-free. If you have severe allergies, please contact the restaurant directly before ordering. YumYaak is not liable for allergic reactions.

3. Accounts, Verification & Privacy

  • WhatsApp Verification: To use YumYaak, you must register using a valid mobile phone number. You consent to receiving order updates and OTPs via WhatsApp.
  • Account Deletion: In compliance with App Store policies, you may request the permanent deletion of your account and data at any time via the App settings.
  • Female Customer Protocol: We have a Zero Tolerance Policy for harassment. Riders are strictly prohibited from saving customer numbers or sending non-delivery related messages. Any such misconduct will result in an immediate permanent ban and police reporting.

4. Orders & Cash on Delivery (COD)

Pricing & Taxes: All prices are in PKR and include applicable GST/Provincial Sales Tax as per Khyber Pakhtunkhwa Revenue Authority (KPRA) rules.

Surge Fees: Delivery fees may vary dynamically based on high demand, heavy rain, or severe weather conditions. The final fee will be clearly displayed before checkout.

No Order Amendments: Once an order is placed, it cannot be modified (e.g., adding extra items). You must place a new order for additional items.

Exact Change Policy: It is your responsibility to provide exact or near-exact change. Riders carry limited cash for safety reasons.

Strictly No Credit (Udhaar): Our riders are NOT authorized to offer credit or 'write it down' for later. Full payment is due upon handover.

Refusal to Pay & No Returns:

No Returns: Food is a perishable good. Once accepted, items cannot be returned or exchanged due to personal taste preference.

Refusals: You may ONLY refuse to pay at the doorstep if:
1. The food has spilled/leaked significantly.
2. The item is completely incorrect (e.g., wrong dish).

5. Delivery, Privacy & Restricted Zones

Respect for Privacy (Chadar aur Char Diwari)

To respect family privacy and local customs, our riders are strictly instructed NOT to enter the main gate of any residence. Delivery handover must take place at the main gate or street level. Please do not ask riders to bring food inside the home.

Cantonments & Checkpoints: If you are located inside Kohat Cantt or a security zone where riders are denied entry, you agree to collect your order at the main gate or checkpoint. Failure to collect will still incur full charges.

Address Accuracy: You must provide a precise location pin. If unreachable for 5 minutes, the rider may leave to deliver other orders.

6. Vouchers & User Conduct

Vouchers & Promos: Promotional codes have no cash value, are non-transferable, and may expire without notice. YumYaak reserves the right to cancel any voucher if fraud is suspected.

You agree NOT to:

  • Harass, abuse, or threaten delivery partners.
  • Promo Abuse: Create multiple accounts (using different SIMs) to exploit "First Order" discounts. We track device IDs and will block offenders.
  • Defamation: Post false, unverified, or malicious claims about YumYaak or its restaurant partners on social media.

7. Intellectual Property

All content, including the YumYaak logo, app design, and code, is the property of YumYaak. You may not copy or use our branding without permission.

8. Software Disclaimer

The YumYaak platform is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the app will be uninterrupted, bug-free, or error-free. We are not liable for any data loss or service interruptions caused by software glitches or maintenance.

9. Liability & Indemnification

Limitation: To the maximum extent permitted by law, YumYaak is not liable for indirect damages or food quality issues. Our total liability is limited to the value of the specific order.

Indemnification: You agree to indemnify and hold YumYaak harmless from any claims, losses, or legal fees arising from your violation of these Terms, your misuse of the platform, or your violation of any third-party rights (including riders or restaurants).

10. Miscellaneous

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Language: These Terms may be translated into other languages (e.g., Urdu, Pashto, Hindko, or Punjabi) for local convenience. In the event of a conflict or ambiguity between translations, the English version shall be the legally controlling document.

11. Governing Law

These Terms are governed by the laws of the Islamic Republic of Pakistan, including the Khyber Pakhtunkhwa Consumer Protection Act. Any disputes shall be subject to the exclusive jurisdiction of the courts in Kohat, Khyber Pakhtunkhwa.
